1. Identification and acceptance

ArgentinaXP.com (hereinafter, “ArgentinaXP”, “the site” or “we”) is an online advertising platform geared towards the Argentine market. These Terms and Conditions govern the use of the site and the contracting of advertising space.

Accessing, browsing, or contracting any service on ArgentinaXP implies full and unreserved acceptance of these Terms. If you do not agree, you must leave the site.

Any formal inquiries, requirements, or notifications may be addressed to the channels indicated in point 18.

2. Definitions

  • User / Visitor: Person accessing the site to consult advertising content.
  • Advertiser: An adult individual who contracts advertising space to promote their independent professional services as an escort, masseuse, or adult content creator.
  • Membership: Advertising plan contracted by the Advertiser with defined duration and characteristics.
  • Content: text, images, videos, and any other material posted by the Advertiser in their listing.

3. Legal capacity and age of majority

To use ArgentinaXP, whether as a User or Advertiser, you must be over 18 years of age according to Argentine law (Art. 25 CCyC).

This site contains adult content. By entering, you certify that you are of legal age, that you are not offended by adult content, and that your access to this site does not violate the laws of your place of residence.

The display, retransmission, or distribution of site content to persons under 18 years of age may constitute the crimes provided for in the Articles 128 and 129 of the Penal Code.

4. Service Description

ArgentinaXP is an online classified ads platform. Our role is limited to hosting and displaying the ads that each Advertiser voluntarily and independently creates.

  • We are not an agency, intermediary, representative, or employer of the Advertisers.
  • We do not participate in, organize, or intervene in any meetings, services, or transactions that the Advertiser agrees to with third parties.
  • We do not guarantee the establishment of contacts or the veracity of the data that the Advertiser decides to publish (beyond the visual identity verification described in point 5).

5. Advertiser Registration and Verification

To publish an advertisement, the Advertiser must complete an initial verification process that includes:

  • Presentation of National ID, passport, or driver's license in effect.
  • A visual comparison between the foto graphs to be published, a verification video, and the document.
  • Express confirmation of legal age and of acting voluntarily and independently.

Without verification, there is no publication. ArgentinaXP reserves the right to reject registrations without stating a reason when there is reasonable doubt about the applicant's identity, age, or willingness.

Monthly periodic check. In addition, ArgentinaXP conducts a monthly verification via video in which the Advertiser states the current publication date. This verification confirms that the person holding the ad is still the same person who was verified at the time of the alta and that the published content belongs to that person. Refusal or unjustified delay in complying with this verification may result in the suspension of the ad until the issue is resolved.

The presentation of false or altered documents, or the use of third-party identities, constitutes a crime according to the Articles 138, 139, 292 to 298 of the Penal Code and enable immediate criminal complaint.

6. Advertiser's Obligations and Declarations

Upon publishing, the Advertiser declares and warrants, under its sole responsibility, that:

  1. They are over 18 years old and act on their own account and will, without coercion, deception, or third-party intervention.
  2. The published foto images, videos, and data belong to you, or you have express and verifiable authorization to use them.
  3. Do not reproduce third-party material without consent, respecting the right to one's own image.Article 53 CCyC and art. 31 Law 11.723).
  4. The information in the notice is truthful and current.
  5. He/She/They carries out his/her/their activity personally, autonomously and on his/her/their own account, without dependence or subordination with respect to ArgentinaXP.
  6. You will indemnify ArgentinaXP against any third-party claims arising from its content or its activity (see point 14).

7. Prohibited Content and Criminal Offenses

It is absolutely prohibited to publish, in any form, content that involves or constitutes:

  1. a) Crimes against the sexual integrity of minors:
  • Any depiction of individuals under 18 years of age in a sexual or sexualized context (Article 128 of the Criminal Code, production, distribution, and possession of child sexual abuse material).
  • Contact with minors for sexual purposes by electronic means — grooming (article 131 CP).
  • Facilitating or promoting child prostitutionArticle 125 bis CP).
  1. b) Human trafficking and exploitation:
  • Trafficking, transfer, reception, or harboring of persons for the purpose of exploitationArticles 145 bis and 145 ter CP, Law 26,842).
  • Promotion or facilitation of prostitution through deception, violence, threat, abuse of authority, or exploitation of a vulnerable situationArt. 126 of the Criminal Code).
  • Economic exploitation of prostitution ruffianism (Art. 127 CP).
  1. c) Dissemination of intimate images without consent:
  • Publication or distribution of intimate material of third parties without express consentLaw 27,736 - Olimpia Law, amending the Civil and Commercial Code).
  • Coercion by threat of spreading intimate images sextortion.
  1. d) Computer crimes (Law 26.388):
  • Unauthorized access to systems (Art. 153 bis CP), computer damage (Arts. 183 and 184 CP), identity theft, and phishing.
  • Any content that compromises the security of the site or Users.
  1. e) Other prohibited content:
  • Third-party personal data (phone, home address, national ID number) without their consentLaw 25.326).
  • Copyright-protected material without a licenseLaw 11.723).
  • Discrimination, hate speech, or incitement to violenceLaw 23.592).
  • Explicit or paid offers of sexual services. Advertisements promote escort services, massages, or content creation; agreements between consenting adults are made privately and off-site.
  1. f) Additional editorial restrictions:

Due to internal platform policy, and in order to guarantee identity traceability and prevent situations of vulnerability, ArgentinaXP does not accept advertisements that include:

  • Individuals with facial tattoos that affect visual identity verification.
  • Pregnant individuals, at any stage of gestation.

The application of these restrictions is discretionary and does not require further justification to the Advertiser.

The failure to comply with points a) through e) authorizes the immediate cancellation of notice without refund, the criminal complaint to the competent authorities and the digital evidence preservation in accordance with point 11. Failure to comply with point f) authorizes the rejection or cancellation of the notice without reimbursement of the unused period.

8. Memberships, Pricing, and Payments

  • Membership plans, their features, and prices are published in the relevant section of the site and may be updated at any time. Changes will not affect memberships already contracted during their term.
  • Payments are made through the means enabled on the site.
  • ArgentinaXP does not store complete data; processing is handled by the payment provider you choose.

9. Validity, renewal and cancellation

  • Each membership has the duration indicated at the time of hiring.
  • Renewal is not automatic unless expressly enabled by the Advertiser.
  • The Advertiser may request the cancellation of your advertisement at any time, without needing justification, by writing to [email protected]. The cancellation is processed immediately.
  • The early termination of a paid membership does not generate a refund for the unused period, unless the cause is attributable to ArgentinaXP.

10. Suspension and Removal of Ads

ArgentinaXP may suspend, modify, or delete an advertisement, in whole or in part and without prior notice, when:

  • Detect violations of these Terms or Company Policy.
  • Receive a verifiable report of illicit content.
  • Be required by a judicial or police authority through a formal order.
  • There are indications of the commission of any of the crimes listed in point 7.
  • The Advertiser does not comply with the monthly periodic verification described in point 5.

In cases where the suspension is due to a cause attributable to the Advertiser, there is no refund.

11. Cooperation with criminal justice and preservation of evidence

ArgentinaXP fully cooperates with Argentine judicial and police authorities in response to legitimate and formal requests (court orders, digital searches).

Before detection, suspicion, or verifiable report of the commission of the crimes listed in point 7, ArgentinaXP proceeds to:

  1. Remove content immediately.
  2. Preserve digital evidence Available: dates and times, verification document, initial and monthly verification videos, published content, internal communications, and proof of payment.
  3. Report to the competent authorities when appropriate, without prior order, especially in cases of crimes against minors and human trafficking.
  4. Close Advertiser Account and prevent new registrations from data identified as linked to conduct, within the technical capabilities of the site.

The Advertiser acknowledges and agrees that submitting false information or using the site for illicit purposes exposes them to the corresponding criminal and civil actions., being solely responsible without this applying to ArgentinaXP.

12. Site Intellectual Property

The design, code, trademarks, logos, and all content belonging to ArgentinaXP are protected by Law 11.723 and the Trademarks Law 22.362. Its use, reproduction, or adaptation without authorization is prohibited.

The Advertiser retains ownership of its published content, but grants ArgentinaXP a free, non-exclusive license, limited to the duration of the advertisement, to host, display, and promote it within the site and its official channels.

13. Limitation of Liability

ArgentinaXP is not responsible for:

  • The agreements, encounters, or transactions that the Advertiser enters into with third parties.
  • The veracity of the data in the notice, beyond the identity verification described in point 5.
  • Illicit conduct by the Advertiser or third parties using the site in violation of these Terms.
  • Damages arising from the temporary inability to access the site due to technical reasons, force majeure, or acts of God.
  • External linked content.

This limitation does not apply in cases of fraud or gross negligence by ArgentinaXP, according to Art. 1743 CCyC.

14. Indemnity

The Advertiser undertakes to hold ArgentinaXP harmless from any administrative, judicial, or criminal claims initiated by third parties as a consequence of the content published or the Advertiser's activity, assuming associated legal costs, fees, and any eventual judgments.

15. Privacy and Personal Data

The processing of personal data is governed by our Privacy Policy and by the Law 25.326. The enforcement authority is the Agency for Access to Public Information (AAIP), before which any owner can file a complaint.

16. Modification of Terms

ArgentinaXP may modify these Terms at any time. The current version is the one published on this page, with its update date at the beginning. Substantial changes will be notified to active Advertisers via their registered email.

If an Advertiser does not accept a modification, they may request termination in accordance with section 9.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Argentine Republic. For any dispute, the parties submit to the ordinary courts seated in the Autonomous City of Buenos Aires.
