1. Identification and acceptance

ArgentinaXP.com (hereinafter, “ArgentinaXP”, “the site” or “us”) is an online advertising platform oriented towards the Argentinian market. These Terms and Conditions govern the use of the site and the contracting of advertising spaces.

Accessing, browsing, or contracting any service on ArgentinaXP implies full and unreserved acceptance of these Terms. If you do not agree, you must leave the site.

Any formal queries, requirements, or notifications can be directed to the channels indicated in point 18.

2. Definitions

  • User / Visitor: person who accesses the site to view advertising content.
  • Advertiser: An adult individual contracting for advertising space to promote their independent professional services as an escort, massage therapist, or adult content creator.
  • Membership Advertising plan contracted by the Advertiser with defined duration and characteristics.
  • Contents text, images, videos and any other material published by the Advertiser in their advertisement.

3. Legal capacity and age of majority

To use ArgentinaXP, whether as a User or Advertiser, you must be over 18 years of age according to Argentine legislation (art. 25 CCyC).

This site contains adult content. By entering, you declare on oath that you are of legal age, that you do not find the adult content offensive, and that your access to it does not breach the law applicable in your place of residence.

The exhibition, retransmission or distribution of site content to persons under 18 years of age may constitute offences provided for in the Articles 128 and 129 of the Criminal Code.

4. Service Description

ArgentinaXP is an online advertising notice platform. Our role is limited to hosting and displaying the advertisements that each Advertiser creates voluntarily and independently.

  • We are not agents, intermediaries, representatives, or employers of the Advertisers.
  • We do not participate in, organise, or intervene in any meetings, services or transactions that the Advertiser agrees with third parties.
  • We do not guarantee the establishment of contacts or the accuracy of the data that the Advertiser decides to publish (beyond the visual identity verification described in point 5).

5. Advertiser Registration and Verification

To post an advertisement, the Advertiser must complete an initial verification process which includes:

  • Presentation of National Identity Document, passport or driving licence in force.
  • A visual comparison between the foto graphs to be published, a verification video and the document.
  • Express confirmation of being of legal age and acting voluntarily and independently.

Without verification, there is no publication. ArgentinaXP reserves the right to reject registrations without stating a reason when there is reasonable doubt about the applicant's identity, age, or willingness.

Monthly periodic verification. In addition, ArgentinaXP carries out a monthly verification via a video in which the Advertiser states the current publication date. This verification confirms that the person holding the advertisement is still the same person who was verified at the time of the alta and that the published content corresponds to that person. Refusal or unjustified delay in complying with this verification may result in the suspension of the advertisement until the matter is resolved.

The presentation of false or altered documents, or the use of third-party identities, constitutes a criminal offence under the Articles 138, 139, 292 to 298 of the Penal Code y enabling immediate criminal prosecution.

6. Advertiser's Obligations and Declarations

Upon publication, the Advertiser declares and guarantees, under their sole responsibility, that:

  1. They are over 18 years of age and act on their own account and will, without coercion, deception, or third-party intervention.
  2. The foto images, videos and data published here are either his own or he has express and verifiable authorisation to use them.
  3. Do not reproduce third-party material without consent, respecting the right to one's own image.Article 53 CCyC y Article 31 of Law 11.723).
  4. The information in the notice is truthful and up-to-date.
  5. They carry out their activity personally, autonomously, and on their own account, without dependence or subordination to ArgentinaXP.
  6. ArgentinaXP shall indemnify and hold harmless against any third-party claims arising from its content or its activity (see clause 14).

7. Prohibited content and criminally punishable conduct

It is strictly forbidden to publish, in any form, content that involves or constitutes:

  1. a) Offences against the sexual integrity of minors:
  • Any representation of persons under 18 years of age in a sexual or sexualised contextArt. 128 of the Criminal Code, production, distribution and possession of child sexual abuse material).
  • Contact with minors for sexual purposes by electronic means Grooming (Article 131 of the Criminal Code).
  • Facilitating or promoting child prostitutionArticle 125 bis of the Criminal Code).
  1. b) Trafficking in persons and exploitation:
  • The procurement, transportation, reception or harbouring of persons, by threat or use of force, coercion, abduction, fraud, deception, abuse of power or a vulnerable position, or by giving or receiving payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation.Articles 145 bis and 145 ter of the Criminal Code, Law 26,842).
  • Promotion or facilitation of prostitution through deception, violence, threat, abuse of authority or exploitation of a vulnerable situation.Article 126 of the Criminal Code).
  • Economic exploitation of prostitution ruffianism (Art. 127 Criminal Code).
  1. c) Sharing intimate images without consent
  • The publication or dissemination of intimate material relating to third parties without their express consent (Law 27.736 – Olimpia Law, (amending the Civil and Commercial Code).
  • Coercion through the threat of distributing intimate images sextortion.
  1. (d) Computer-related offences (Law 26.388):
  • Unauthorised access to systems (Art. 153 bis of the Criminal Code), computer damage (Arts. 183 and 184 of the Criminal Code), identity theft and phishing.
  • Any content that compromises the security of the site or Users.
  1. e) Other prohibited content:
  • Third-party personal data (phone number, home address, national ID number) without their consentData Protection Law 25,326).
  • Copyrighted material without a licenceLaw 11.723).
  • Discrimination, incitement to hatred or violence.Law 23.592).
  • Explicit or paid offers of sexual services. The advertisements promote companionship, massages or content creation; arrangements between consenting adults take place in private and off-site.
  1. f) Further editorial restrictions:

Due to the platform's internal policy, and in order to guarantee identity traceability and prevent situations of vulnerability, ArgentinaXP does not accept advertisements that include:

  • Individuals with facial tattoos that affect visual identity verification.
  • Pregnant individuals, at any stage of gestation.

The application of these restrictions is discretionary and does not require further justification to the Advertiser.

Failure to comply with points a) to e) authorises the Immediate withdrawal of the notice without refundthe criminal complaint to the relevant authorities and the preservation of digital evidence in accordance with point 11. Failure to comply with point (f) may result in the rejection or cancellation of the booking without a refund for the unused period.

8. Memberships, prices and payments

  • Membership plans, their features, and prices are published in the relevant section of the site and may be updated at any time. Changes will not affect memberships already purchased during their term.
  • Payments are made by the methods enabled on the site.
  • ArgentinaXP does not store complete data; processing is handled by the chosen payment provider.

9. Validity, renewal and termination

  • Each membership has the duration indicated at the time of purchase.
  • Renewal is not automatic unless expressly enabled by the Advertiser.
  • The Advertiser may request your notice at any time, without needing to provide a reason, by writing to [email protected]. The cancellation is processed immediately.
  • Early termination before the expiry of a paid membership does not generate a refund for the unused period, unless the cause is attributable to ArgentinaXP.

10. Suspension and removal of advertisements

ArgentinaXP may suspend, modify or delete a notice, in whole or in part and without prior notice, when:

  • Detect any violation of these Terms or the Company Policy.
  • Receive a verifiable report of illicit content.
  • To be required by a judicial or police authority through a formal order.
  • There are indications of the commission of any of the offences listed in point 7.
  • The Advertiser does not comply with the monthly periodic verification described in point 5.

In cases where the suspension is due to a cause attributable to the Advertiser, there is no refund.

11. Cooperation with criminal justice and preservation of evidence

ArgentinaXP cooperates fully with Argentine judicial and police authorities in response to legitimate and formal requests (court orders, digital searches).

Before any detection, suspicion or verifiable report of the commission of the offences listed in point 7, ArgentinaXP shall:

  1. Remove content Immediately.
  2. Preserving digital evidence Available: dates and times, verification document, initial and monthly verification videos, published content, internal communications, and proof of payment.
  3. Report to the relevant authorities when appropriate, without prior order, especially in cases of offences against minors and human trafficking.
  4. Close the Advertiser account and prevent new registrations from data identified as linked to the behaviour, within the technical capabilities of the site.

The Advertiser acknowledges and accepts that submitting false information or using the site for illicit purposes exposes them to corresponding criminal and civil actions., being solely responsible which cannot be extended to ArgentinaXP.

12. Website Intellectual Property

design, code, trademarks, logos and all proprietary content of ArgentinaXP are protected by the Law 11.723 and the Trademarks Act 22.362. Its use, reproduction or adaptation without authorisation is prohibited.

The Advertiser retains ownership of their published content, but grants ArgentinaXP a free, non-exclusive licence, limited to the duration of the listing, to host, display and promote it within the site and its official channels.

13. Limitation of Liability

ArgentinaXP is not responsible for:

  • Agreements, meetings or transactions that the Advertiser enters into with third parties.
  • The veracity of the notice's data, beyond the identity verification described in point 5.
  • Unlawful conduct by the Advertiser or third parties using the site in violation of these Terms.
  • Damage arising from the temporary inability to access the site due to technical reasons, force majeure or unforeseen circumstances.
  • Contents of externally linked sites.

This limitation does not apply in cases of wilful misconduct or gross negligence on the part of ArgentinaXP, in accordance with Article 1743 of the Civil and Commercial Code.

14. Indemnity

The Advertiser undertakes to hold ArgentinaXP harmless against any administrative, judicial or criminal claims initiated by third parties as a consequence of the published content or the Advertiser's activity, assuming associated legal costs, fees, and potential judgments.

15. Privacy and personal data

El tratamiento de datos personales se rige por nuestra [Data Protection Policy]. Privacy Policy and by the Data Protection Law 25,326. The enforcement authority is the Access to Information Agency (AAIP), to which any owner can report.

16. Amendment of Terms

ArgentinaXP may modify these Terms at any time. The current version is the one published on this page, with its update date at the beginning. Substantial changes will be notified to active Advertisers via their registered email.

If an Advertiser does not accept a modification, they may request termination in accordance with point 9.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Argentine Republic. For any dispute, the parties submit to the ordinary courts based in the City of Buenos Aires.
